Jiva Workshop Booking Terms & Conditions
Jiva Workshop Photography & Video and the Client hereby acknowledge that the following Standard Terms and Conditions are incorporated in and make a part of the Agreement between the parties hereto.
Engagement and Services
The Agreement is between Jiva Workshop Photography & Video and the Client that has engaged our services that is named in any correspondance recieved including emails and messages via social media. The Client wishes to engage Jiva Workshop Photography & Video and Jiva Workshop Photography & Video accepts the engagement to hereby:
(a) provide photography & Video Services to the Client and
(b) produce Digital Photographs and/or Video supplied on USB, DVD or Bluray
Contract and Payment Arrangements
Acceptance of our contact terms and conditions is made upon booking our services and a 50% non-refundable retainer is required to secure your booking as we are often booked in advance. Final payment is required on delivery of the final products.
These Terms and Conditions may be varied at any time, with or without notice to you, at our sole discretion. You accept that these must be read in conjunction with the current Terms and Conditions available at: www.jivaworkshop.com.au on the bottom of the website. Our terms and conditions apply to all previous, current and future clients.
The Client agrees to pay the Fee to Jiva Workshop Photography & Video. All amounts payable under this Agreement are inclusive of GST. All additional costs such as permits to photograph in national parks or on beaches that require permits, if any, are the responsibility of and must be paid for by the Client.
If a cancellation is made within 12 months from the wedding date, Jiva Workshop Photography & Video reserves the right to charge the Client the full Fee regardless of how much work has been carried out prior to or after the cancellation including all post processing work which would have been carried out should the wedding have gone ahead.
Jiva Workshop Photography & Video will provide a schedule for the time that the client has booked. The schedule will include all known times for each component of the wedding day. It is the responsibility of the client to inform Jiva Workshop Photography & Video of any changes or additions made to the schedule no sooner than 7 days prior to the wedding date. Jiva Workshop Photography & Video is not responsible for any omissions to the schedule that result in us not being able to carry out our duties. Jiva Workshop Photography & Video will not be held responsible for any lack of photographs delivered due to unknown changes or omissions.
Limitations from venues
Please note that Jiva Workshop Photography & Video is governed by the restrictions imposed by churches and venues. In some cases, venues restrict the movement of photographers, the use of flash or in extreme cases prevent the taking of photographs at all. It is the responsibility of the client to inform themselves of these restrictions and inform Jiva Workshop Photography & Video prior to the wedding date. Jiva Workshop Photography & Video will not be held responsible for any lack of photographs delivered due to these restrictions.
Copyright in the photographs is retained by the client for private, domestic and personal use only. Any sale or commercial use must have written approval by Jiva Workshop Photography & Video. Jiva Workshop Photography & Video asserts all moral rights attached to the Photographs and the Client does NOT have the right to edit, change, add to, take from, alter or otherwise amend the Photographs without the prior written consent of Jiva Workshop Photography & Video except in the case of cropping an image. The client may submit images to their other vendors for social media use only or to “real weddings” sections of websites, magazines, and blogs, however, a credit to Jiva Workshop Photography & Video as the photographer and videographer must be given in the form of either a social media handle or direct website link. Image Style & Editing Process
The client acknowledges that they are familiar with our style, and that our work is continually evolving and are of a unique and artistic nature, that the photos taken may be different from those taken in the past and that Jiva Workshop Photography & Video will use their expertise and artistic judgement to create images and video consistent with their vision of the wedding, which may be different from the clients. Our editing encompasses colour grading of all selected images and video for the client in Lightroom, Premiere, After Effects however, our prices do not include cropping or advanced editing/retouching such as individual removal of pimples, scars, double chins or distracting elements. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out.
Jiva Workshop Photography & Video may use the photographs for advertising or otherwise promoting their work. The couple must inform Jiva Workshop Photography & Video in writing if they do not wish to have their images used in any advertising or promoting. (written request’s to not have images of yourself or guests published are in all cases honored. However, this does not include additional shots of venues, B-Roll and images that don’t include recognizable people in them)
Jiva Workshop Photography & Video will keep copies of both your finished jpegs for 5 years and your RAW files for two years from the date of your wedding.
All clients will be supplied with high-resolution jpeg and/or MP4 files upon final delivery of USBs as well as any DVD’s or Blurays requested. At no stage will RAW files of photographs be delivered. Online galleries will be uploaded within a week of the final delivery of USB Drives excluding public holidays. Final delivery of USB drives will be around six weeks after the wedding excluding public holidays and delivery times.
You may be able to purchase a copy of the RAW footage for video upon request.
In the unlikely event your chosen photographer or Videographer is unable to complete the coverage due to unforeseen circumstances such as serious injury, illness or death; we will work together to find a professional photographer or videographer to cover your day.
Loss or Damage
Jiva Workshop Photography & Video shall carry out this assignment with due and professional diligence. Elements that are beyond our control include interruption of our service due to other hired photographers, guests, guest photographers, faulty material, equipment failure or damage or loss of digital files. In the case of digital file loss,Jiva Workshop Photography & Video and the client agree that the liability ofJiva Workshop Photography & Video shall be limited to a full or partial refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.
Every effort will be made to capture as many moments of your day as we find possible, however it is not possible to capture absolutely everything. If you have suggestions or desires for photos to be captured such as a surprise dance down the aisle or a set photo of the groom and his mum, please write them down on a list for me and I will do my best to get them. Because of the ever-changing nature of wedding days, not everything can be covered.Jiva Workshop Photography & Video is not responsible for a missing family member(s) during the family photo session.
The client is responsible for the conduct of their guests. Jiva Workshop Photography & Video will not tolerate verbally or physically abusive behavior including harrasment of any kind. If the client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer or videographer, it will result in the early or immediate departure of the photographer or videographer. The client understands that in such an event, no refunds will be granted.
Jiva Workshop Photography & Video makes every effort to work professionally with other vendors. However, we have no control over how others may act. We sometimes need to rely on other vendors to obtain materials for your products including sound feeds etc. If a vendor refuses to work with us to obtain the needed materials then Jiva Workshop Photography & Video can not be held liable for the product being diminished in quality.
If a vendor endangers our equipment. In example, a DJ who has laser lights that can damage the sensors of our camera’s and refuses to turn them off. The client understands that Jiva Workshop Photography & Video will have to refuse covering those elements of the wedding. The client agrees that no full or partial refund shall be given in any of these circumstances.
